16. DISPUTE RESOLUTION; BINDING ARBITRATION

Any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or any product purchased from us (collectively, “Disputes”) shall be resolved through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Arbitration shall be conducted on an individual basis and not in a class, consolidated, or representative action.
The arbitration shall take place in King County, Washington, unless otherwise required by applicable law or unless the parties agree to conduct the arbitration remotely.
Nothing in this section prevents either party from bringing an individual claim in small claims court located in King County, Washington, provided the claim qualifies for small claims jurisdiction.
17. 30-DAY RIGHT TO OPT OUT OF ARBITRATION
You have the right to opt out of the arbitration agreement contained in Section 16 by sending written notice of your decision to opt out within thirty (30) days of first accepting these Terms.
To opt out, you must email legal@ososupplyco.com with the subject line “Arbitration Opt-Out” and include your full name, mailing address, and the email address associated with your order or account.
If you opt out of arbitration, Sections 16–18 shall not apply to you, but all other provisions of these Terms will remain in effect.
18. CLASS ACTION WAIVER
YOU AND OSO SUPPLY CO AGREE THAT ANY PROCEEDINGS SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
You waive any right to participate in a class action lawsuit or class-wide arbitration.
If the class action waiver is found unenforceable, the arbitration agreement shall be null and void.
19. JURY TRIAL WAIVER
YOU AND OSO SUPPLY CO WAIVE ANY RIGHT TO A JURY TRIAL IN ANY PROCEEDING ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE WEBSITE.
20. SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

If for any reason a Dispute is not subject to arbitration, you agree that exclusive jurisdiction and venue shall be in the state or federal courts located in King County, Washington.

We may assign our rights under these Terms. You may not assign your rights without our written consent.
